Section 1.4 Disclaimer of Consequential Damages

IN NO EVENT SHALL PROPERTYPLAZA.COM.MY, ITS SUPPLIER, OR ANY THIRD PARTIES MENTIONED AT THE SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL, SPECIAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE SITE AND THE MATERIAL, WHETHER BASED ON STATUTE, CONTRACT, TORT, OR ANY OTHER LEGAL CAUSE, AND WHETHER OR NOT MYHOME IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

By uploading, posting, emailing, publishing or transmitting your submission, you are granting propertyplaza.com.my to use your submission in connection with the operation of its Internet businesses including, without limitation, the rights to copy, distribute, transmit, publicly display, reproduce, edit and reformat your submission.

1.4.3 Links to Other Sites

Sites to which you link through propertyplaza.com.my are independent of the site and we have no control over them and accept no liability in respect of your use or inability to use them or any of the content of such sites. We accept no liability with respect to any of the products, information, material or services offered or provided by other organization listed on, or linked to propertyplaza.com.my

1.4.4 General

The Site is controlled by propertyplaza.com.my from its location within Malaysia . Propertyplaza.com.my makes no representation that Materials are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws.

Any disputes, claims or proceedings arising out of or in any way relating to the Materials or the Site shall be governed by the laws of Malaysia . The Malaysian Courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in any way relating to the Materials or the Site. Without prejudice to the foregoing, Propertyplaza.com.my may seek provisional or protective relief in the courts of another State prior to, during or after any substantive proceedings have been instituted in Malaysia and propertyplaza.com.my may bring enforcement proceedings in another state on foot of an Malaysian judgment.

If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term.

THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN YOU AND PROPERTYPLAZA.COM.MY WITH RESPECT TO THE USE OF THE SITE. Any changes to this Agreement will be posted on the Site and will take immediate effect.

PROPERTYPLAZA.COM.MY may at any time and without liability modify, suspend or discontinue the Site or any Materials (or any part or specification thereof), with or without notice, for any valid technical, operational or commercial reasons.

 

Section 2: Terms and Conditions bound to advertisers of Property Plaza magazine

All advertisement booking must be governed by the rules and conditions of the Publisher, who reserves the right to change or amend these rules whenever necessary.

Notwithstanding the terms and conditions stated on the advertisers’ or agencies’ contracts, the placing of an order or contract will be deemed an acceptance of the publisher’s rules and regulations.

The publisher will not responsible for any omission to insert an advertisement and reserves the right to reject or cancel any order without explanation, notwithstanding acceptance of payment.

The publisher is indemnified against all claims, actions, suits demand, losses, costs and expenses in respect to advertisement published under instruction from an advertiser or his advertising company.

Placement of ads on specified page is subject to availability and charge according to the package. Whilst the publisher endeavors to place all ads in the best position possible. The ads will be placed at discretion of the publisher

Advertisement space are sold is governed by the publisher’s technical data

Restriction on size of advertisement is governed by prevailing conditions and will vary from time to time according to publisher’s advice

Please provide copy of English for publication, translation from Chinese set to English will be charge a translation fee.

The advertiser should furnish the publisher with name, I/C No. and other particulars.

Please provide full final copy writing and photos to publisher. The publisher can provide the services of designing the artwork and copywriting to the client. In such case, a reasonable fee will be charged.

In the case where the digital artwork is provided by the client, the publisher will not responsible for any technical fault or any different in artwork compare to the original reference due to incompatible computer operation system.  

Copy Deadline:

·          6 week before publication date.  Publisher reserves the right to public advertiser’s advertisement to next issue if publisher received the copy within 6 week of publication

·          The publisher reserves the right to change the deadlines as and when necessary.
